NIS 2: still some divergences between the Parliament and the Council
On 26 January, MEP Bart Groothuis (Renew, the Netherlands) spoke about the NIS Directive during a session of the ITRE Committee. Bart Groothuis is leading the negotiations on this file for the European Parliament. Negotiations with the Member States are progressing. Bart Groothuis said that a first trilogue āwent wellā.
For the Council side, Fabrice Dubreuil takes part in the negotiations. Fabrice Dubreuil is the French vice-permanent representative. Roberto Viola, Director General of DG CNECT (European Commission) was also present.
The French presidency indicated that the conclusions of the negotiations on NIS 2 is a priority. They intend to complete the negotiations in April.
MEP Bart Groothuis explained that the biggest divergence of views relates to the scope of the directive. The Member States underline that they just finished the implementation of NIS 1, they are reluctant to a large scope, especially the inclusion of public administrations. By contrast, the European Parliament believes that Member States should lead by example, therefore administration bodies should be part of the scope. In addition, the European Parliament wants to include research and academia, as well as charging stations for electric vehicles.

Trilogues will take place on the following dates:
- Thursday 17 February, 9.00-12.00, in Strasbourg
- Thursday 17 March, 14.00-17.00
- Thursday 28 April, 9.30-12.30
If an agreement is found in April, the Council could vote on the text on 3 June.
